That’s how U.S. District Judge Sam Sparks once described a city of Austin ordinance that prohibits landlords from rejecting low-income applicants who plan on paying part of their rent with a Section 8 federal housing voucher if they meet all the qualifications for tenancy.
But more than a month later, Sparks decided not to grant an injunction, requested by the Austin Apartment Association, that would have blocked the ordinance. That was surprising to some who had heard his prior remarks, but to others, it’s consistent with other court cases on the subject.
